A TELEMEDICINA COMO FERRAMENTA DE EFETIVAÇÃO DO DIREITO HUMANO FUNDAMENTAL À SAÚDE PARA A POPULAÇÃO PRIVADA DE LIBERDADE NA BAHIA NO CONTEXTO DO COVID-19

ABSTRACT:
People deprived of liberty in the Brazilian and Bahian penitentiary system have suffered from overcrowding, as well as health problems in the pandemic context of COVID-19. Therefore, this research aims to highlight the health status of people deprived of liberty in Bahia in the context of the pandemic, checking whether there was a worsening of the health situation in that panorama. The importance of telemedicine and regulatory changes in the context of the pandemic will be demonstrated. Finally, telemedicine will be proposed as a public policy for the realization of the right to health in the prison system. The legal-sociological methodological approach was used, based on doctrinal, legislative and jurisprudential research on the subject. Data from SISDEPEN were also used in order to highlight the health panorama involving people deprived of liberty in Bahia, in the pandemic scope. The conclusion reached is about the need to use telemedicine to ensure a dignified health status for people deprived of liberty in the Bahian prison system.
