DISREGARD IN BRAZIL
Resumo
Abstract: This paper expects to delve into the applicability of the disregard theory in Brazil. It proposes an overview of the Brazilian legislation and the courts approach on the subject. The main concern of the research is to picture whether the theory has been properly accepted and identify eventual drawbacks in its development. To understand how the doctrine has been applied in Brazil the research suggests a quick consideration on the reasons that fostered states to create the legal entity apart from its members, to limit their liability and to review this rule later on.
