A HOMENAGEM AOS ASCENDENTES COMO MOTIVO JUSTO AO ACRÉSCIMO DE SOBRENOME: UMA INTERPRETAÇÃO DA EXPRESSÃO “MOTIVADAMENTE”, CONSTANTE DO ART. 57 DA LEI DE REGISTROS PÚBLICOS, À LUZ DA HERMENEUTICA PÓS-POSITIVISTA

Resumo

Tomando como ponto de partida a diversidade e equivocidade na análise hermenêutica de alguns magistrados e membros do Ministério Público, a respeito do requisito “motivadamente”, presente no art. 57 da Lei 6.015/73, que ao rechaçarem a possibilidade de acréscimo de sobrenome, alegando ausência de justo motivo, tendo por fundamento, causa de pedir, a homenagem aos antepassados, acabam por ensejar retrocesso aos avanços da Ciência do Direito, é que este artigo trata da “Homenagem aos ascendentes como motivo justo ao acréscimo de sobrenome: uma interpretação da expressão ‘motivadamente’, constante do art. 57 da Lei de Registros Públicos, à luz da hermenêutica pós-positivista”, tendo-se, pois, a hermenêutica como vertente norteadora a explicitar que a homenagem aos ascendentes constitui, sim, motivo justo a acrescer sobrenome que integra a linhagem familiar de quem requer.

ABSTRACT: Starting on the diversity and ambiguity in the hermeneutics analysis of some judges and members of the public prosecutor, regarding the induced’ requirement, provided in art. 57 of Law 6,015/73, that rejects the possibility of inclusion of a surname, claiming the lack of due cause, based, in the cause of action, a tribute to the ancestors, ultimately setbacks the advances of law, is that this article deals with "Honor to the ancestors as a due cause to the inclusion of surname: an interpretation of the term 'induced', in the art. 57 of the Public Records Law, in the light of hermeneutics post-positivist " therefore, hermeneutics as the guiding part to clarify that the tribute to the ancestors is a good cause, in adding surname lineage that includes his family.
